1. GC: You will have before you 408 lots in blocks 1 to 21 inclusive, J. C. Owen addition, City of Richmond California, lying on 25th, Owen, 27th, 28th, 29th Sts., and Hamilton, Seaver and Meeker Sts. These lots given in contract Aug. 6, 1926, to K. Perrin and contract assigned to Lord Realty Co. of which A. E. Aerial of 118 West 82nd St., N.Y. City is president. Contract has lapsed, and notice given of cancellation. Will one year redemption apply to this foreclosure? You will answer the questions which I will ask you regarding these.

2. EC: Yes, we have conditions surrounding these.

3. Now, we find - with the lapse of contract and conditions surrounding same - property values are much increased, by contemplated buildings in this portion of subdivision. While this might be forced by the manner in which notice was served, and a forced delivery made, yet this would itself entail troubles when developments are shown, and unless there was the proof that there was no fore-knowledge concerning this increased valuation, this would be taking advantage of the other individual, and individuals so involved. Hence we would find, considered from this viewpoint, this would be rather a touchy proposition, unless one desired to put making of money first.

4. (Q) Will one year redemption apply to this foreclosure? (A) As given, in the manner in which the citation was made - which is irregular, or was irregular - the delivery could be forced, but - consider conditions surrounding same.

5. (Q) Can contract as written be taken up at this date upon payment of full price? or will sellers refuse to deed the property? Can they be made to give deed upon presentation of purchase price? (A) A forced issue would make the sellers delivery the deed, yet those conditions as surround same would make this rather an unusual, or one would be - with the knowledge of conditions and the advancement - that of taking advantage of another fellow, and the conditions surrounding same.

6. (Q) Will this be a paying proposition, taking over contract? (A) Dependent upon what one would term paying. In dollars and cents, yes. In troubles as would be brought by same as the result of taking advantage, no. As to the moral conditions as surrounded same, not so good.

7. (Q) Is Arthur E. Aerial a business associate with whom [900] and [195] will have pleasant relations? (A) Very good.

8. (Q) Is Ford plant to be built adjoining this property? (A) Including some of same, yes.

9. (Q) What is approximate present value of above 408 lots? (A) Dependent upon whether the valuation is as of present status or of that valuation when these contracts are closed, or operations begun. This would be a very valuable piece of property. Forty - fifty - hundred and fifty - several thousands of dollars, you see.

10. That is all the questions.

11. We are through with this reading.
