Time of Reading 11:50 to 12:20 A. M. Eastern Standard Time. New York City. (Body & enquiring mind, in regard to associates & associations; especially the Court of Justice Frankenthaler in the Supreme Court at Worth & Center St., N.Y., and inform me as to the results of the [[3734] & [257]] situation, advising me what I should do now. You will answer the questions which will be asked.)
1. EC: Yes, we have the body, the enquiring mind, [257], and those associations and relations.
2. In regard to the suit, the fine, and the situations, as we find, these have not as yet materially changed since last we had same here; and, as given, as to whether this order is to be sustained or not depends upon the manner it is presented when it is in the status where it may be re-opened; or it will call for some decisions on the part of those handling same, as to how they may present it so it will NOT be closed when the fine is paid - and the whole of the order sustained, see? The paying of the fine should be, then, a portion of the agreement that this IS to be re-opened or to be heard as to whether it is to be sustained; for, if the whole order is sustained, then there will not only be the requiring of the turning over of the list of securities, but the securities themselves - and these for reference as to the ownership, which will require then the opening of an ENTIRELY different character of case - see? If these are a portion of the original - that is, we are as this (as attorney): We are assuming that the order as given for fine is sustained only in order that there may be presented the conditions that were misrepresented, that brought about the ordering of the condition as set. This, we find, in the present condition.
3. As to what activity of the Justice would be, this depends - to be sure - on the manner it is presented.
4. As to how it should be presented, it should be done in the manner that is in accordance with the facts in the case.
5. Ready for questions.
257-121 Page 2
6. (Q) What lawyer should go before the Judge today, if any? (A) We have given the one to handle this.
7. (Q) When best for me to reach N.Y. with my family? (A) In time for the entering of those things that may be presented, which - as we find - if these are presented today, then they will require the action, of course, on the morrow. If these are not presented until tomorrow, then the next day would be better.
8. (Q) There's no danger of [wife [903]] going home at same time, is there - of any embarrassment? [She being Pres. of Ky. Estates.] (A) None other than what must necessarily come with questioning.
9. (Q) Any changes for me because of publicity since Saturday reading? (A) No material changes.
10. (Q) How has Mr. Buckley of the Cleveland Plant, and who is now located at Youngstown, O., Truscon, taken this whole situation? (A) Little or no interest at the present, save as to the questioning as to whether this is a condition that would prevent the handling of the conditions or the accounts with Truscon.
11. (Q) Will [257] be able to show that the conditions are alright? (A) He will answer according to that determined by the Court; he can't go behind that!
12. (Q) Is Buckley a friend of [257]'s in the business? (A) There would be many conditions to be considered, were this to be answered yea or nay; for, while these have little to do with the conditions that are referred to in the present, there have been periods when these have been rather as cross-purposes. With the handling of those allotments that have been made to the organization ([257]'s) through the regular channels, and the handling of the accounts as to the settling of same, these have been more satisfactory recently. And some questions have arisen in the present regarding that already on hand. If the allotments are taken care of, then the whole situation clears itself as regarding Buckley, Truscon, and those situations there.
13. (Q) How soon should I attempt to answer article with same publicity? (A) That depends upon whether the article is to be used as a means or channel to react upon the publicity, but to do such will necessitate causing a greater amount of publicity.
14. (Q) So the Forces think it's best to drop it? (A) Unless it is determined, by that already stated and that may be stated in the situations yet to be met, that these become of such a nature as to be defamation to the
257-121 Page 3
abilities of the body to carry on in the regular order. Then get something out of it! and let there be all the publicity you want to! If it is not sufficient for defamation, or for a hindrance to the body in making the regular relations to the financial business world, and in carrying on for the family and dependent ones, then you'll necessarily let it drop. No use causing more publicity and then be considered or shown up to be one that has put things in such a way as to not be touched.
15. (Q) To which of my business affairs should I give most attention for next 7 days, Refrigeration, Barrels or Liquor? (A) Straightening these situations here, and getting rid of the refrigeration contracts. Then in making those associations and connections for the barrels, or the contracts with the foreign, local or national associations for the conditions that are gradually arising. For, as we find, by the 7th of December there should be hard liquor in the United States.
16. (Q) Is prospectus prepared by [1565] now sufficient for Bartlette? (A) Should be sufficient. This has been given before, as to what is necessary. With the meetings and associations, this should be sufficient.
17. (Q) Is this the time for me to work closely with Sam'l Ungerleider? (A) In getting the situation between those whom the body has contacted and making the relations, don't let it drop - as we have given. This should be put on such a basis that the activities of the body, the connections that have been made, should be worth while to the body. To THAT extent the associations or connections should be maintained.
18. (Q) Is it necessary to reduce contracts to writing with Mr. Ungerleider? (A) As we find, it is not necessary - but when all the conditions through which the body must eventually pass are considered, at least NOTATIONS should be made - not exactly contracts.
19. (Q) Mr. Ungerleider suggested a merger between the American Anchor Rayon Corp. and the Industrial Rayon Corp., of which he is one of the moving factors. [257] has explained it to Gen. McRoberts. What should [257] now do to follow this up? (A) Follow up the reaction had by the General. Then follow out those leads or connections directed through the channel for bringing about a consideration of the proposition. Know what the situation is, from the contacts that would be made through those leads as would be pointed out, we find it won't work yet.
20. (Q) Should Seely be notified anything of it, while he
257-121 Page 4
is in Europe, so he can talk to the Dutch? (A) Be very good; be better channel this way.
21. (Q) Should [257] write him, or the General? (A) The General AND [257].
22. (Q) How can I further cement friendship between Bronfman interest & Ungerleider? (A) It's very good as it sets at present. Just keep what you've got, and don't try to stretch that by drawing on either one; save as to making what self's interests are in same.
23. (Q) In what way should Mr. Schwartz, who is now in N.Y., function in this connection, as he made the introduction to the Canadian people? (A) Only as that sought or asked. To have an understanding that such associations or connections made for a cut-in at all times, sometimes would - especially in this particular case - make for dissension rather than harmony. If there be any in which he would figure, there would only be a verification by going over the whole situation (by Schwartz) as to the interests of the validity of the connections, and the abilities for them to be made worth while. See?
24. (Q) What should be the working arrangement between [257] & Schwartz - would 50-50 be more satisfactory? (A) More than satisfactory. This is confusing, however. Don't let it get crossed.
25. (Q) What value to me at this time would be an association with A. T. Bradstreet of 67 Grove Ave., Madison, Conn.? Would I be better off working alone or with him? on liquor questions? (A) There may be some association that might be made worth while, but if the conditions are such (and this should be judged by [257], by his conversation with Bradstreet) that the activities of [257] are safer without, than with others, there are those conditions or activities that demand that counsel be had between the two.
26. (Q) We have not received the order for the water coolers in Washington, which the Forces expected us to get by Aug. 15th. Please explain delay. (A) For it has been held up by those cuts in the amounts of the dispensing of those conditions. As long as there were the cutting downs in the various channels through which these were to be supplied, see? These are still, as yet, in abeyance. Portions of this are being released now in a very short while, possibly by the 10th or 15th of this present month; then only a portion will be carried forward. Don't let it lapse out, but do not expect to receive same until there is sufficient of the releasing of these moneys in
257-121 Page 5
these departments for the carrying on of this portion of work.
27. (Q) Should [257] go to Washington now and see Lewis, or wait? (A) To communicate with him would be just as well; then, when the conditions arise, have Lewis come to New York.
28. (Q) Is there anything we can do on the metal houses, which Lewis is handling, at this time? (A) Just insist that he keep in touch with the situation, and as soon as plausible to open further negotiations for the closing of these, then do so. It has not passed out yet.
29. (Q) Where can [1565] sell the 2,000 Copeland boxes for a quick sale? (A) Through some of those channels that have been held in abeyance for some time; those in the Metropolitan, those in some of the connections in other places round about. Don't forget Metropolitan, though!
30. (Q) Please explain what is Metropolitan? Metropolitan area, or what? (A) Metropolitan INTERESTS!
31. (Q) Copeland has been taken over by Mickey Morris, a former associate of [257]. Is there anything between the two that could be worked out at this time? (A) Be very well to consider the situation; get together. He is still friendly in the associations and connections, and still believes in [257].
32. (Q) Is Lauterstein connected in any way with the situation? (A) Has a finger in it, yes - but let him keep out!
33. (Q) Do the Forces think I should keep entirely away from the the old interests Lauterstein and Isaacs? (A) Where their paths cross, and they be worked together - or that are of mutual interest and are handled by some one else, and not by the associations between Lauterstein and Isaacs and [257], don't be bullheaded - but don't walk into the traps that they would lay for you!
34. (Q) Considering the consternation that [257] is naturally in at this time, please give him a formula or a plan which he will follow to get the necessary cash to continue to carry on the upkeep of his business, family associations, and this Work. [Work:E.C.] (A) In considering these things, there's much to be taken into consideration as to the advice and counsel that has been given heretofore, respecting the activities of self mentally and the associations and connections throughout. And, as we find in the present, if these are to all be taken in their proper order and form, this would in the present
257-121 Page 6
appear to be somewhat out of line with that as would be best. Yet, to carry on, keep the faith in the abilities of self. Keep self so clean in the relations, mentally and materially, with the associates in every direction, that the faith and confidence in self is not lessened; and in so doing there will be given from day to day that necessary - for not only the sustenance of self, self's relations, but to carry on in a way that would be acceptable in His name.
