Time of Reading 4:05 to 4:20 P. M. Eastern Standard Time. ..., Alabama. (Body and enquiring mind, and of her husband, Dr. [...], who seek information, advice and guidance as to the estate of her brother, Dr. [4263], who died on August 4, 1936, to which she is sole heir. Considering the situation as outlined in the correspondence from Dr. [...], which I hold in my hand, you will advise them just what their procedure should be in order to get control of the estate - which is in a Trust Company handled by [...] of ..., Ala., a cousin of the late Dr. [4263]. Ques.)

1. EC: Yes.

2. In giving advice or counsel regarding this, many phases of the experiences of each of these as they are interested must be taken into consideration.

3. That it, the trust, has been recognized by the state, and that there has been received from the estate moneys in line with provisions set forth in the trust, would preclude there being any activity - unless there may be proof that there is not an honest administering of the estate.

4. There are periods when there may be sought a report by those interested; that is, Dr. [...] and Mrs. [1644] may have - from the administrator of the trust and the estate - a report to the county officers, to whom such reports are necessarily made. And under the provisions of trust funds as regulated by state and national income, this MUST be reported each year - as to what, as to how it has been administered, what are the amounts and where invested and how they have been administered, and what has been paid from or received by same.

5. And this, as a beneficiary in such a fund, may be asked for, and had, by those so interested.

6. As to whether or not there was undue influence used at the time of the forming of the trust is out of the question

in the present - unless there is proof that there is not a full, honest administration of the trust as to investments, as to the proper distributions of incomes according to the will and to the trust, it must remain as is.

7. Ready for questions.

8. (Q) Is this trust being carried out as it should be? (A) As indicated, this may be asked for through the local county as well as state & national questionings, and a copy of same may be a part of the record for this entity, [1644]. And as such, the judgements of self as well as those in authority may be passed on same. We do not find fault.

9. (Q) Is there any way we can get control of the estate? (A) If there had been the desire on the part of the brother when this was made, for such to be the case, then it would have been so administered! Unless there is proof that it is not being administered in some form correctly, we do not find that it can be changed - or that it is BEST that it be!

10. (Q) Was my brother satisfied with the Trust just before he passed away? (A) Had he lived longer there would have been a change. This does not indicate, however, that he was dissatisfied altogether with the manner in which it was administered.

11. (Q) Was he influenced by any certain person in making it? (A) This is not a part of the approach at all. Unless there is to be, of course, more than half of the whole estate given to somebody else, that you may have control of a little portion of it! and then it's very doubtful whether there would be any at all or not! Better take it as it is!

12. (Q) Any other advice regarding same? (A) This can only be, in peace and harmony for all concerned, administered in the manners that were directed by the will itself. And this may be had by the appeal to the authorities to whom the trustee or the administrator necessarily has to report each year. Do that.
