Time of Reading 3:20 P. M. Eastern Standard Time. ..., Florida.

1. GC: You will have before you the ... Real Estate Company and [...], President, and their suit in chancery court in Dade County, Florida, against the ... Corporation and [2671] and you will answer the questions which I will ask you regarding this litigation, which case is coming up for trial the 14th of this month.

2. EC: Yes, we have those conditions and transactions as relate to a suit as respecting those conditions; this to be called on February 14th. Be some attempts to change this, though, from this. Ready for questions.

3. (Q) Was [...] President of the [...] Real Estate Co., during April, May and June, 1921? and when was he elected or appointed President? Give copy of minutes showing his election. (A) The election of [...] as President shows as of the minutes of the meeting on February 27th, see?

4. (Q) What year? (A) Twenty-one (21).

5. (Q) What will be the court's decision in this case, and will it be decided this month? (A) There are complications as respecting this, and there will be the attempt to delay, under the present circumstances and conditions. The court should - SHOULD - decide in favor of the sale and of the contracts as were set at this time, see?

6. (Q) Is the evidence now prepared and being prepared such as will secure verdict for ... Corporation and [2671]? (A) It will.

7. (Q) Are the attorneys for ... Corporation handling the case properly? If not, will you suggest proper procedure? (A) Yes - we would not offer any change from these. There is only one conditon that should be called to mind, which is as this: In the presentation of the minutes of the meeting - as of the records, see, that are made - see that these minutes are on the same sheets of paper. Some of the alterations and changes being given are of different mill papers, see?

8. (Q) Was [...] President of the ... Real Estate Co., during April, May and June, 1921? and when was he elected or appointed Preseident? Give copy of minutes showing his election. (A) President during those months, as seen by the minutes - as given - and, as seen, changes were not made in these - in fact, until in July, see?

9. (Q) What are the changes being made in the minutes? (A) As to the right of individuals to contract for certain conditions, and as to who drew and made such contracts and their official capacity. See that the original (as is prepared on all) is on the same paper, see?

10. (Q) Will this case go to the Supreme Court of Florida for its final decision? (A) We do not find it so - for all parties as concerned in the transaction in the transfer of those things wherein the capacity as official in that as has been set forth in the pleadings here, and these should be evidence, on the face of that as has been prepared in respect to same, see? Then why should it go to discount that as is prime official evidence in the conditions set forth?

11. (Q) Any other information that will be of assistance to the ... Corporation and [2671] regarding this? (A) The claims are correct. Hold to that as has been set forth.

12. (Q) When will the decision be made by the court? (A) The arguments, you see, will be presented at first for a change, or a delay in these conditions, and as to the mind of that one before whom it will be presented, and as the evidence as presented for same - no one would give what the change of the mind would be, for that's the will of the man - and in the final evidence we would find, in its presentation, the end of this should come in the first or second week in March, this year.

13. (Q) Will this decision be in favor of the ... Corporation and [2671]? [See Mr. [943]'s letter 8/26/27 under 5741-12 Reports saying that the suit WAS decided in [2671]'s favor.] (A) Should be - for, as given, the evidence as presented, and those conditions as surrounding same, is correct and true.

14. That is all the questions.

15. Now, there are many various angles to conditions as surround this suit. There is as evidence by the stand, and of those associated with the President of ... Real Estate Corporation, that there was behind that of the President that which caused this first trouble, see? in the attempt to shield another. But why should the ... Corporation be

made the goat for the other man!

16. We are through, then, for the present.
